Cresta Palace Celerina AG (Cresta Palace Hotel) in 7505 Celerina will gladly arrange a relaxing stay for you. To ensure your satisfaction, please carefully read the following Terms and Conditions, which form part of the Contract. Thank you for your time and understanding.
1.1 - The conclusion of the Contract is governed by the provisions of the Swiss Code of Obligations. The Contract is generally entered into through both parties’ signature of the Booking Confirmation or the unconditional acceptance of a Hotel offer by the Guest.
1.2 - The Guest’s own terms and conditions apply solely subject to express prior agreement in writing.
1.3 - Should the Guest wish to receive services that are not provided by the Hotel itself, the Hotel shall solely act as an intermediary. These services will be invoiced separately.
2.1 - The prices are indicated in the concluded Contract (Booking Confirmation) and the price list on which this is based. They are quoted in Swiss francs.
2.2 - Unless otherwise agreed, the prices includes breakfast.
2.3 - Depending on the scope of the booking, the Guest must pay in advance or provide a credit card and signature by way of guarantee. If a deposit is agreed, this must be paid within the specified period, otherwise the Hotel will be free to dispose of the room as it wishes.
2.4 - Unless otherwise agreed, the Guest must pay the invoice upon check-out at the latest. The Hotel accepts the following payment methods: Cash, credit card (MasterCard, VISA, American Express, Diners Club, Jelmoli Bonus Card and CUP), debit card (Maestro, V-Pay and Postcard) and American Express traveller’s cheques. Other traveller’s cheques are not accepted.
2.5 - Hotel invoices without a due date are payable in full within 10 days of their issuance. The Hotel is entitled to invoice accrued amounts at any time and demand immediate payment. In the event of a default on payment, the Hotel is entitled to charge the legally accepted interest rate of 5% of the invoice total. This does not affect the Hotel’s right to claim higher amounts of damages upon provision of evidence of these.
2.6 - All agreed prices include value added tax and other taxes. The Hotel reserves the right to adjust agreed prices as a result of changes to the statutory taxes.
Guests may check in to their room from 3 p.m. and must check out by 11 a.m. on the day of departure. Should the Guest wish to arrive earlier or depart later, the room can be made available accordingly upon prior agreement with the Hotel. Should the Guest stay in the room for longer without prior agreement, the Hotel is entitled to charge up to 50% of the list price for the room up to 6 p.m. and 100% of the list price for the room after 6 p.m.
4.1.1 - Should a Guest check in for a pre-booked room later than agreed, not check in at all or check out early, the following cancellation conditions apply:

The cancellation fees will be calculated based on when the Hotel receives the cancellation.
4.1.3 - The Cresta Palace Hotel reserves the right to change the cancellation fees depending on the scope of the booking; such changes will be specified in the Booking Confirmation (Contract). The Guest may only obtain an exemption/change to the cancellation deadlines with the Hotel’s written consent.
4.1.4 - The Hotel must offset the income from letting the room to another Guest against the cancellation costs.
4.2.1 - Rooms may only be used for the purpose of overnight stays. The Hotel is entitled to terminate the Contract with immediate effect and without further notice if the Contract has been entered into under the provision of false or misleading information or if the room is not used in line with the Contract.
4.2.2 - If an agreed pre-payment has still not been made following a suitable grace period provided by the Hotel, the Hotel is entitled to rescind from the Contract.
4.2.3 - The Hotel is furthermore entitled to extraordinarily terminate the Contract for an objectively justified reason, for example: – if force majeure or other circumstances out of the Hotel’s control make it impossible to fulfil the contract – if the Hotel has justified cause to believe that the use of the Hotel services could pose a risk to its smooth business operations, safety, security or the Hotel itself.
4.2.4 - If the Hotel justifiably rescinds from the contract, the Guest has no right to compensation.
4.2.5 - If the Hotel is unable to comply with its performance obligation as a result of overbooking, it must offer the Guest an equivalent service in a different hotel.
5.1 - The Hotel is liable for Guests’ possessions in line with legal requirements. The liability for slight negligence is expressly excluded.
5.2 - The Cresta Palace Hotel does not assume any liability for services provided by subcontractors within the Hotel, namely Coiffeur Trudy & Flury.
5.3 - Should the Guest incur harm or damages or be dissatisfied with the Hotel’s services, he/she must report this to the Hotel immediately. Otherwise, the Guest will no longer be entitled to assert his/her rights.
5.4 - Unless longer periods are established by law, all claims against the Hotel expire six months after check-out.
6.1 - Where possible, all amendments or additions to the Contract or Booking Confirmation must be made in writing. One-sided amendments or additions are invalid.
6.2 - By signing the Contract/Booking Confirmation or confirming a booking, the Guest accepts the Terms and Conditions.
6.3 - This Contract is exclusively subject to Swiss law.
6.4 - The Parties agree that Celerina/St. Moritz, Switzerland, is the sole place of jurisdiction.
